Penal Code 290: “California Sex Offender Registration Act”
A conviction for a sex crime, even if you have served your sentence, may follow you for a long time. Penal Code 290 PC, known as the “California Sex Offender Registration Act,” requires anyone who is convicted of a sex crime to register as a sex offender. This is perhaps one of the most serious penalties you may face if you are convicted of a sex crime in California. If you or a loved one has been charged with a sex crime, you need an experienced Los Angeles criminal defense lawyer to fight for you. For over fifteen years, Simon M. Aval has been representing people accused of sex crimes in Southern California. His experience and knowledge can help you get the legal protection you need.
The Sex Offender Registration Act
Under California Penal Code §290, if you live in California after being convicted of a California sex crime, you are required to register with the police department of the city or county where you reside. Under this Sex Offender Registration Act, you must renew your registration 1) every year, within five (5) working days of your birthday, and 2) every time that you move to a new residence.
Failing to Register As a Sex Offender
If you fail to register as a sex offender under Penal Code 290 PC, California law imposes penalties that may further frustrate your attempt to live a “normal” life. Failure to register as a sex offender may result in:
- Up to one (1) year in county jail if the initial sex crime conviction was a misdemeanor; or
- Up to three (3) years in state prison if the initial sex crime conviction was a felony, or if it is your second conviction for failing to register.
However, a failure to register may not automatically result in such harsh penalties. You may not have knowingly or willfully failed to register. Any of these facts may serve as a legal defense. You need the help of experienced Los Angeles criminal defense attorney Simon M. Aval to pursue every opportunity to defend your rights, your future and your freedom.
